At SalusEMR, we are committed to ensuring that all communications with our users comply with the applicable laws, including the Texas Business and Commerce Code (Chapter 46, regarding electronic mail). This Anti-Spam Policy outlines how we prevent, manage, and respond to unsolicited electronic messages and protect the privacy of our users. This Policy will be applicable to all the Services offered by Salus EMR through its domains and sub-domains that may be used for transmission of messages, communications including through email. We prohibit unsolicited commercial emails and use of purchased lists of recipients to those users who have expressly denied or revoked consent to receive such communications. Moreover, we expect that our customer’s email practices also comply with the applicable and relevant legal requirements in the respective jurisdictions where they reside.
1. What is Spam?
Spam refers to unsolicited electronic messages, primarily email, sent in bulk for commercial purposes without the recipient’s prior consent. Under Texas law, the sending of certain commercial electronic mail messages without prior consent is prohibited, and deceptive practices in email communication are strictly regulated. In addition, Salus EMR is strictly in compliance with laws of different jurisdictions of the recipient users and in compliance with international standards and treaties to which the United States of America is a signatory and where the same has been ratified.
2. Our Commitment
· All communications from SalusEMR.com or from any of its affiliates, consignees or any other third party (“Sender”) who uses the platform of Salus EMR, are directed only to users/customers who have explicitly opted in to receive updates, newsletters, or service-related messages.
· We do not send unsolicited emails or other electronic communications without the express consent of the users/customers, which will conspicuously be presented to such user/customer for them to provide their express consent to receive such communications. Salus EMR values the privacy of its users/customers and will not embed such communications (to obtain consent) in terms of privacy policies, etc.
· All users/customers will be expressly informed of the kind of communications they will receive, for what purpose these communications will be sent and from whom they will receive such communications before the said users/customers grant express consent to receive such communications.
· After a user/customer grants his/her consent to receive the communications (as mentioned above), they will receive an email from subscriptions@salusemr.com confirming their agreement to receive such communications in the future.
· We ensure compliance with Texas spam laws (Texas Business and Commerce Code, Chapter 46), which prohibits false or misleading subject lines, unauthorized use of email addresses, and other deceptive practices.
· We also ensure compliance with the Controlling the Assault of Non-Solicited Pornography and Marketing Act, 2003 (“CAN-SPAM”).
· We further ensure compliance with stipulations or provisions under international treaties and standards to which the United States of America is a signatory and where the same has been ratified.
3. User Consent
Users are required to provide explicit consent (opt-in) before receiving any commercial communication from SalusEMR.com. In this regard, Salus EMR will expressly provide a user the option to either opt-in or opt-out from receiving such communications before any such communication, commercial in nature, is sent to the user.
· Users can withdraw their consent at any time by using the "unsubscribe" link provided in every email or by contacting our support team at contactus@saluremr.com .
· We comply with all opt-out requirements, ensuring that any request to unsubscribe is honored within a reasonable period, as required by Texas law or under any law applicable in the recipient’s jurisdiction, as may be amended from time to time.
· By using the Services offered, the user agrees to abide by the Privacy Policy, Terms of Use, Terms of Service and this Anti-Spam Policy.
· The user agrees to determine any other additional anti-spam or data protection laws which may apply to the user/customer, based on the jurisdiction they are residing in or carrying on business in and further comply with those laws, including all corresponding rules and regulations.
4. Prohibited Practices
We strictly prohibit the following activities in accordance with applicable State and Federal laws. Salus EMR does not allow any form of lists of recipients which has either been purchased, rented or borrowed. No user will be allowed to contact the recipients without there being any express consent provided in accordance with the procedure established in this Policy. Following is a list of prohibitions which are non-exhaustive requirements in accordance with CAN-SPAM:
· Sending unsolicited commercial emails without the recipient’s express consent.
· Using false or misleading information in the subject line or the "From", “To”, “Reply” of “Reply To” field of any email, including the originating domain name and email address, which makes the recipient capable of easily understanding and identify the Sender of the communication.
· Failing to provide a functioning return email address, physical address, or opt-out mechanism.
· Harvesting email addresses from our website or user database without authorization.
· Acquiring, receiving, procuring, gathering or securing, for any gain or otherwise, of any email address from an affiliate party or any other third party, irrespective of any claim, while using the Services offered by Salus EMR. It is further strictly prohibited to send emails to the addresses acquired, received, procured, gathered or secured through any means whatsoever other than those addresses which have either been provided by Salus EMR through its Services/Platform or which have been expressly approved by Salus EMR.
· Not Providing a choice to the users/customers to “unsubscribe” from the commercial communications/marketing communications.
· Not honoring any such unsubscribe request within 10 working days of receipt of any such request.
· Communication from the “sender” must include a valid physical postal address, which includes a valid street address, a post office registered with the U.S. Postal Service or a private mailbox which is registered with any private mail company established under the applicable laws.
5. Reporting Spam
If you believe you have received unsolicited or suspicious emails from SalusEMR.com or that someone is misusing our services to send spam, please report it immediately to abuse@salusemr.com. All reports are thoroughly investigated, and necessary actions will be taken to resolve any violations in accordance with Texas law.
6. Consequences of Violations
Violations of this Anti-Spam Policy or applicable laws may result in:
· Suspension or termination of user accounts.
· Legal action as per Texas Business and Commerce Code §46.001 et seq., which permits individuals to bring legal action for spam violations.
· Any other remedies deemed appropriate to protect the privacy of our users/customers and the integrity of our platform.
7. Compliance with Texas and Federal Laws
In addition to Texas laws, SalusEMR.com complies with the federal CAN-SPAM Act and other applicable regulations. This includes the requirement to include accurate header information, subject lines, and opt-out mechanisms in all commercial emails.
8. Changes to this Policy
SalusEMR.com reserves the right to modify this Anti-Spam Policy at any time to ensure compliance with new regulations or changes in our practices. We will notify users of significant changes via email or through our website.
